The following Terms & Conditions (“Terms”) describe the terms and conditions that apply to the purchase, acceptance, and use of any prepaid, stored‑value virtual instrument issued by Weee! and redeemable solely for eligible goods/services from www.sayweee.com (a “Gift Card”). These Terms incorporate by reference Weee!’s Terms of Service (available at https://www.sayweee.com/en/about/terms-of-service).
By purchasing, accepting, or using a Gift Card, you agree to be bound by these Terms and acknowledge our Privacy Policy (available at https://www.sayweee.com/en/about/privacy-policy). If you do not agree with these Terms, do not purchase, use, or accept the Gift Card.
For purposes of these Terms, “Weee!” includes Weee! Inc, and any of its predecessors, successors, assigns, parents, subsidiaries, affiliates, and sister companies.
1. Gift Card Issuance
Gift Cards may only be purchased from Weee! or an authorized seller. Purchase of Gift Cards from authorized sellers may be subject to additional terms and conditions of such sellers. In the event of a conflict between these Terms and the terms and conditions of an authorized seller, these Terms shall prevail.
We may refuse, cancel, or delay any Gift Card order at our discretion. We may set per‑order, daily, and account‑level purchase/redemption limits, delivery schedules, and restrict high‑risk uses (including bulk orders without prior approval).
Gift Cards may not be used for cash advances, to purchase other stored‑value instruments, or for any illegal or high‑risk activities.
2. Using Your Gift Card
Gift Cards are redeemable only at www.sayweee.com for the purchase of eligible goods/services by residents of the United States, excluding U.S. territories. Eligible goods and services are subject to change without notice in Weee!’s sole discretion.
To redeem your Gift Card, go to https://www.sayweee.com/en/account/gift-card/redeem and enter the Gift Card code.
Unless otherwise specified, Gift Card balances and unredeemed Gift Cards do not expire and are not subject to fees. Unclaimed balances will be handled per applicable escheat/unclaimed property laws.
3. No Cash Redemption, Refunds, or Resale.
Gift Cards are not reloadable, not refundable, and not redeemable for cash, except as required by law.
Gift Cards may only be purchased by or gifted to individuals, and may not be resold, transferred for value, or obtained from unauthorized sellers. Once redeemed, Gift Card balances may not be withdrawn from your Weee! account or transferred or assigned to another person or account.
A Gift Card is not valid and will not be honored by us, and we will not be liable for the value of the Gift Card, if it is obtained from an unauthorized seller or reseller and/or redeemed by, or used in conjunction with an account of, a person who is not a resident of the United States.
4. Intellectual Property
Gift Cards may not be used in connection with any marketing, advertising or other promotional activities without our prior written approval. Use of the Weee! name, any Weee! logo, or the logos of any other company within the same group as Weee! (an “Affiliate”), and any of their trade dress or trademarks in connection with the purchase and/or use of a Gift Card is strictly prohibited. Furthermore, the use of Gift Cards in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or is otherwise affiliated with, Weee!, Weee!’s services, or any Affiliate is prohibited without our prior written approval.
5. Lost or Damaged Cards; Fraud
Do not share a Gift Card code or PIN number with anyone except the intended recipient. Risk of loss passes upon electronic delivery to the purchaser or designated recipient (including email delivery). We are not responsible for lost, stolen, destroyed, or misdirected cards or for unauthorized use. We may, at our discretion and with proof of purchase, replace a card and transfer any available balance.
Gift Cards are subject to verification. We use fraud and risk controls and may require identity, payment, or purchase verification before activating or redeeming a Gift Card. We may delay activation, place holds on, freeze, void, cancel, or refuse to honor any Gift Card, any related transaction, or any redemptions or balances funded by a Gift Card, with or without notice, if we suspect or confirm fraud, unauthorized use, illegal activity, error, abuse, violation of our Terms, or unusual activity suggesting risk.
We may also suspend or close associated customer accounts, limit use of other payment methods, decline additional purchases, and share information with financial institutions and law enforcement as permitted by law.
6. Chargebacks; Reversal of Redemptions; Setoff
If the payment instrument used to purchase a Gift Card is reversed, disputed, declined, or charged back, we may at our sole discretion:
a) void or reduce the Gift Card and its balance;
b) reverse any redemptions funded by that Gift Card (including canceling associated orders or services, or requiring return of goods);
c) charge an alternative payment method on file or request a new form of payment;
d) deduct the amount from any credits, balances, or payouts we hold for you; and
e) invoice you for amounts owed and pursue collection as permitted by law.
7. Errors and Disputes
Keep your original receipt and the Gift Card number. Contact support@sayweee.com promptly to dispute an error or freeze. We may request proof of purchase and identification. If we confirm an error, we will correct the balance as appropriate.
8. Compliance and Reporting
By purchasing or holding a Gift Card, you are certifying and representing to Weee! that you will comply with all applicable laws, these Terms, and that you will not use the Gift Card in any manner that is misleading, deceptive, unfair or otherwise harmful to consumers or Weee!
We may share information with payment networks, banks, and law enforcement to investigate fraud and comply with legal obligations, including lawful requests and court orders.
9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
WEEE! AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED OR STATUTORY, WITH RESPECT TO THE GIFT CARDS OR GIFT CARD BALANCES, INCLUDING BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, AND IMPLIED WARRANTIES OF OR FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, COMPATIBILITY, SATISFACTORY QUALITY, AND NON-INFRINGEMENT.
TO MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WEEE! OR ITS AFFILIATES BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM THE PURCHASE, REDEMPTION OR USE OF A GIFT CARD, HOWEVER CAUSED. NOR SHALL WEEE! BE HELD LIABLE FOR DELAY OR FAILURE IN PERFORMANCE RESULTING FROM CAUSES BEYOND ITS REASONABLE CONTROL.
NOTWITHSTANDING THE FOREGOING, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE AND EXCLUSIVE REMEDY, AND OUR SOLE AND EXCLUSIVE LIABILITY, WILL BE LIMITED TO APPLYING THE TOTAL VALUE OF SUCH GIFT CARD AS A GIFT CARD BALANCE TO YOUR ACCOUNT. SOME JURISIDICTIONS DO NOT ALLOW FOR THE DISCLAIMER OF CERTAIN WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS AND LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, THE EXCLUSIONS APPLY AND LIABILITY IS LIMITED ONLY TO THE EXTENT PERMITTED BY LAW.
10. Changes to Terms
We may update these Terms at any time, with or without notice, even though these changes may affect your ability to use a Gift Card, subject to our compliance with applicable laws. The most current version of these Terms will be made available at https://www.sayweee.com/about/gift-card-terms and will supersede all previous versions.
11. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflicts‑of‑law rules, and subject to consumer protections that cannot be waived. Company operates nationwide, and certain state-specific laws related to gift cards may apply to you in addition to these Terms, including but not limited to requirements regarding cash redemption, expiration, or escheatment. Where required by law, such state-specific provisions will apply notwithstanding any contrary provision in these Terms.
12. Severability
Notwithstanding anything in these Terms to the contrary, if any part of these Terms are deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal and enforceable. If such provision cannot be so modified or restricted, it shall be excised from these Terms without affecting the validity, legality or enforceability of the remainder of these Terms, which shall be fully enforced.
